I develop Prevailing Wage Reports that includes the appropriate occupational group and OES/SOC code, the area of intended employment, the LCA Code and the NAICS Code. The Foreign Labor Certification OES/SOC database changes the way prevailing wage reports are developed and calculated. I know how to develop evidence that an offered job qualifies as a "specialty occupation" and that the job requires the services of a holder of Bachelor's Degree or Master’s Degree. 

Initially, I show how the person's bachelor's degree in the field or a closely related field qualifies for the position by using the O*NET and a standard vocational analysis technique called Transferable Skill Analysis.

The transferable skill analysis, along with the actual job description, is then compared to the matched occupational group description in the O*NET. The comparison demonstrates how the job duties and associated knowledge are so specialized that the job requires a Bachelor's Degree or Master’s Degree as a fundamental requirement in order to perform the assigned work tasks. The fee for this service starts at $498.00 and depending the complexity of the situation can be increased.



The introduction of the new prevailing wage regulations in the "Prevailing Wage Determination Policy Guidance for Nonagricultural Immigration Programs" that was released under cover of a memorandum dated March 7, 2005 and the most recent Memorandum dated May 9, 2005 titled "Revised Prevailing Wage Determination Guidance" now make job description development even more important.

An employer can no longer identify a few job tasks and the educational level for any job offer. Education and training level, field of study, length of education or training and amount of experience are topics that need to be addressed in order to accurately state the job description criteria outlined in the new regulations.

There are no longer just entry and experience level categories. Now, the regulations use four classifications (entry, qualified, experienced & fully competent) for determining were the employer's job offer is classified. Each one has a specific definition that includes criteria that has to be addressed in order for a job offer description to qualify for that classification.

The description of an employer's job offer is now a critical factor. A job offer description that is not correctly written can mean an inaccurate O*NET classification or prevailing wage classification that is thousands of dollars higher then is necessary.

I know that the identification of the correct O*NET occupational group, which states the work tasks, knowledge, skill level and work activities is critical to develop an accurate job description for use in support letters, PERM applications or determining prevailing wages. 


I have been working with the O*NET since it was introduced. I have carefully studied each new O*NET version as they have been introduced. I can accurately identify any job offer with the appropriate O*NET Occupational Group. I can then assist you with the development and writing of the job description and the job title so that it accurately reflects the tasks, educational & training parameters, knowledge requirements, and work activities to be performed according to the employers needs and the U.S. Department of Labor's guidelines in GAL 2-98, GAL 1-00 and the two new memorandums used for prevailing wage determinations.

After completing the job description,  the same government developed worksheet that is used to process prevailing wage referrals is completed and then a Prevailing Wage Report is written that can be used for either an H-1b or PERM, Permanent Labor Certification Application or H1-b.
